uSTADIUM (NextGen Social Sports, Inc.) respects the work of photographers, writers, artists and every other creator, and we expect the people who use our service to do the same. This page explains how to report material you believe infringes your copyright, what we do when we receive a report, and how to reach our designated agent under the Digital Millennium Copyright Act, 17 U.S.C. § 512.

1. Reporting infringement

If you believe material on ustadium.com or in the STAKEZ app infringes a copyright you own or control, send a written notice to our designated agent. To be effective, the notice must include:

1. A physical or electronic signature of the copyright owner, or of a person authorized to act for the owner.
2. Identification of the copyrighted work you say has been infringed. If one notice covers several works, a representative list is enough.
3. Identification of the material you say is infringing, with enough detail for us to find it. A direct link to each item is best.
4. Your name, mailing address, telephone number and email address.
5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or are authorized to act for the owner.

2. Designated agent

Email is the fastest way to reach us. Please put "DMCA Notice" in the subject line.

3. What we do with a notice

We read every notice. When a notice is complete, we remove the material or disable access to it promptly, and we tell the user who posted it, where we can. If a notice is missing something, we will ask you for it.

4. Counter-notice

If you posted material that was removed and you believe the removal was a mistake or a misidentification, you may send the designated agent a counter-notice that includes:

1. Your physical or electronic signature.
2. Identification of the material that was removed and where it appeared before removal.
3. A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled because of mistake or misidentification.
4. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the district where your address is located (or, if you are outside the United States, any district where uSTADIUM may be found), and that you will accept service of process from the person who sent the original notice or that person's agent.

When we receive a complete counter-notice, we send a copy to the person who filed the original notice. We may restore the material no sooner than 10 and no later than 14 business days afterward, unless that person tells us they have filed a court action over it.

5. Repeat infringers

We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe the copyrights of others.

6. Content published by uSTADIUM

If your concern is about something uSTADIUM itself published, on this site or on one of our social accounts, write to the same address. Send a link to the post and tell us which work is yours. We review every message and reply promptly.

7. Be accurate

Under 17 U.S.C. § 512(f), a person who knowingly and materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages. If you are not sure whether something infringes your rights, consider speaking with a lawyer before sending a notice.
